UPDATE: Extension of EB-5 Program

Dear Colleagues and Investors,

On September 29th, 2016, President Obama signed H.R. 5325, a Continuing Resolution (CR) which provides funding for the federal government through December 9th, 2016. Among other things, this legislation extends the four expiring immigration programs through December 9th, 2016.

Amid the expiring immigration programs extended includes the EB-5 Regional Center Program. There is no further word from U.S. Citizenship and Immigration Services, or the U.S. Federal Government generally, about extending the EB-5 Program after the December 9th deadline provided by the Continuing Resolution. Given this, we encourage all individuals exploring the EB-5 option or intending to invest in a U.S. Enterprise through the Regional Center Program, to make their decisions and contact a U.S. immigration attorney as soon as possible.

It is possible that, after the December 9th deadline, the EB-5 Program may change regulations (restricting Regional Center job numbers, increasing investment amounts, or any number of suggestions that have been mentioned in the past), or be terminated entirely. Therefore, we recommend that all those intending to seek Legal Permanent Residence through the EB-5 Program file their Form I-526 (EB-5) Petitions prior to December 9th, 2016.
