Important Considerations for Selection of EB-5 Program
The EB-5 program selection requires the investor to stay with the EB-5 investment for a period of five (5) years. The most important aspect of the EB-5 program is the job creation mechanism that requires the EB-5 developer to follow through on its promise to create the 10 jobs per investor. In reviewing the EB-5 program, the Investor should carefully consider the following major aspects of the EB-5 project:
- The Developer’s business plan
- The Methodology used for job creation
- Whether or not the program creates required number of jobs
- The Developer’s prior track record
- The Geographic Area of the EB-5 investment
- The USCIS regulations which provide that the Developer may not materially change the business plan that was initially submitted in order to receive approval for regional center designation
